Legal Situation in Austria: Medical Abortion
The Legal Basis (Time-Limit Model / Fristenlösung)
The legal foundation is established in the Austrian Criminal Code (§§ 96 to 98 StGB), which was reformed in 1974 through the introduction of the so-called time-limit model (Fristenlösung). Under this law, an abortion is lawful and exempt from criminal prosecution if the following conditions are met:
- The Three-Month Time Limit: The procedure must be performed within the first three months of pregnancy (calculated from the start of the last menstrual period).
- Medical Performance & Consultation: The termination must be carried out by a physician. A prior medical consultation is mandatory, during which the patient is informed about the medical procedures, risks, and alternatives.
Specifics of the Medical Method (Up to Day 63)
The medical abortion method offered in our practice is subject to an additional medical and temporal guideline: in Austria, it is officially approved and possible up to the 63rd day after the first day of the last menstrual period (which corresponds approximately to the end of the 9th week of pregnancy).
No Mandatory External Counseling or Waiting Period
A notable difference from some other European countries (such as Germany) is that Austrian law does not require a mandatory external crisis counseling session or a statutory waiting period following such counseling.
The legally required consultation takes place directly with us at our practice. This allows you to complete this step discreetly, promptly, and within a secure medical environment.
Strict Confidentiality and Self-Determination
- Right to Self-Determination: Legally and personally, the decision for or against an abortion rests entirely with the pregnant woman. The consent of a partner or family members is neither required by law.
- Medical Secrecy: As physicians, we are bound by strict professional confidentiality. All conversations, examinations, and medical records are treated with absolute confidentiality. No one (neither authorities, employers, nor family) will be informed without your
